Divorce vs. Legal Separation
Divorce and legal separation are two common areas of matrimonial law with which people oftentimes need assistance. To understand which of these, if either, is right for you and your marital situation, it is important to understand the difference between the two.
Divorce is the dissolution of a marriage. In the state of Texas, a divorce can be granted on the grounds of: insupportability, cruelty, adultery, conviction of a felony, abandonment, living apart and confinement to a mental hospital. A divorce should only be sought if there is no hope for reconciliation, for all martial assets will be divided during the divorce. Matters such as child custody, spousal support and child support will have to be determined as well.
Legal Separation, in most states, is similar to a divorce, as all property, owned or acquired during the marriage, is divided between the splitting spouses. Matters such as custody and spousal support are dealt with during the legal separation as well. However, legal separation is not recognized by the state of Texas. So, if you want to pursue a legal separation in North Texas, you and your spouse may prepare a separation agreement or a property partition. Though the agreement will not be signed by a judge, it can still be considered an enforceable contract.
If you should need assistance with these matters, a matrimonial attorney will be able to help you determine whether divorce or legal separation is in your best interest. An experienced matrimonial lawyer will also be able to help you understand your rights and choose the most effective course of action in your case.
